The parents of a young boy have been awarded $24.5 million dollars as a result of an accident that left their then 11-year-old son with traumatic brain injury, unable to speak and confined to a bed or wheelchair.  According to the facts in the case, the father was driving with his wife and their 11-year-old son on Interstate 88 when they stopped for construction. The truck driver was heading in the same direction and was looking at the playlist on his cell phone. He struck the plaintiff’s vehicle at about 63 mph.  The adult plaintiffs were injured, but did not require surgery.  Their son, however, suffered life-altering injuries.  In addition to the traumatic brain injury, he required plastic surgeries for facial fractures and cranial defects.  He requires assistance for all his daily living activities.

The plaintiff’s attorney, Stephen M. Passen says his clients were pleased with the result given the devastating incident for the family.
